1. What personal information do we collect?
1.1. The information we collect from you is derived from our credit application forms
you may complete or via our website and such information may include:
- Personal information
- 2.1. Your name, address and contact information; ID/passport number; date of birth; preferred communication methods; Banking details.
- 2.2. In our credit application we will also collect the juristic entity information you provide, such as registration number, directors, shareholders and parent company/ies or subsidiaries. This information is necessary for Financial Intelligence Centre records and POPI will apply to the extent permitted by law.
- Special personal information
3.1. The term “special personal information” in this context refers to information relating to your religious or philosophical beliefs, race or ethnic origin, trade union membership, political opinions, health, sexual life or criminal behaviour. We do not collect special personal information unless it is required in the performance of our mandate and volunteered by you.
4. Personal information about children
4.1. The nature of our business does not require us to collect or process any
personal information in respect of minor children. 5. Contacting us via our Website or otherwise
5.1. When you use the website (our “Site“) or contact us by post, telephone, fax, email, or other electronic communication, we collect, store and use certain personal information that you disclose to us. This includes details such as your name, address, telephone, fax, email and mobile phone number as well as traffic data, location data, web logs and other communication data, whether this is required for our own billing purposes or otherwise and the resources that you access. When you contact us, we keep a record of that correspondence only for as long as it is necessary in accordance with the required legal provisions unless indicated by you to discard such information before the expiry of such time period.
- 5.2. It is expressly prohibited for any person, business or entity to gain unauthorised access to any page on our Site or to deliver or attempt to deliver any unauthorised, damaging or malicious code thereto.
- 5.3. Although we endeavor to maintain the best possible and reasonable measures in place to prevent any unauthorised access, we will not be held liable for any breach which is beyond our control.
- 5.4. It is your responsibility to ensure that when providing information on our website, that you maintain all reasonable security steps in place to safeguard against malware or spyware on your browser.
6. What do we do with personal information collected from you?
- 6.1. We use personal information to provide the services and products you request from the Company.
- 6.2. We may also use the information to advertise products and services, to collect and process payments and maintain accounts and records, to prevent crime and aid in the prosecution of offenders, and to administer and maintaincustomerrecords.
- 6.3. In addition, we use this information to improve our customer services platform, prevent or detect fraud or abuses of our website. The Company retains the copyright in databases of personal information of our customers and website users.
- 6.4. We also use your details to send you newsletters and promotions. We will not engage in the practice of direct marketing by means of unsolicited electronic communications unless you are already a customer of the Company or have given your consent to such processing.
- 6.5. If you apply for employment at the Company, we use the personal information you supply to process your job application.
- 6.6. Other than as set out in this privacy policy we will not share your personal information with third parties for marketing or any other purposes without your consent.
- 6.7. We will share your personal information with authorities only to the extent that we are required to do so by law.
- What about Cookies?
- 7.1. Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser to enable our systems to recognize your browser and to automatically collect information from your computer such as your IP address and other details about your computer which are automatically collected by our web server, operating system and browser type, for system administration and to report aggregate information to us. This is statistical data about our users’ browsing actions and patterns, and does not identify any individual.
- 7.2. The “Help” menu on the menu bar of most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie and how to disable cookies altogether. Additionally, you can disable or delete similar data used by browser add-ons, such as flash cookies, by changing the add-on’s settings or visiting the website of its manufacturer. However, because cookies allow you to take advantage of some of the Company’s essential features, we recommend that you leave them turned on. If you do leave cookies turned on, be sure to sign off when you finish using a shared computer.
- Does the Company share the information it receives?
8.1. Information about our members is an important part of our business and we do not sell it to others. The Company shares customer information only as described below.
9. Third Party Service Providers
9.1. We might from time to time employ other companies and individuals to perform functions on our behalf. Examples include delivery services, credit checks for National Credit Regulator functions and/or other verification or tracing services. Third party service providers have access to personal information needed to perform their functions in terms of a specific mandate, but may not use it for other purposes. Further, they must process the personal information in accordance with this privacy policy and as permitted by South African data protection legislation.
9.2. Our Third Party service providers are contracted in accordance with POPI regulations and are held to the same standards of privacy requirements that we provide our clients.
- Protection of the Company and others
- 10.1. We release account and other personal information when we believe that such a release is appropriate to comply with the law; enforce or apply our customer or other agreements; or protect the rights, property or safety of the Company, our users or others. This includes exchanging information with other organisations for fraud protection and credit risk reduction. Obviously, however, this does not include selling, sharing or otherwise disclosing personally identifiable information from customers for commercial purposes in a way that is contrary to the commitments made in this privacy policy.
- 10.2. With your consent, other than as set out above, you will receive notice when information about you might go to third parties and you will have an opportunity to choose not to share the information.
- How secure is information about me?
11.1. We maintain physical, electronic and procedural safeguards in connection with the collection, storage and disclosure of personally identifiable information. Our security procedures mean that we may occasionally request proof of identity before we disclose personal information to you. Customers and website users where necessary.
12. Cross-territory transfer of information
12.1. In the event that we may need to transfer your personal information to another country for processing, we will ensure that anyone to whom we pass your personal information has similar legislation to our own to treat your information with the same level of protection as to which we are obligated.
13. Storage of data
13.1. We retain your personal data only for the period necessary for the purposes
set out in this Policy or in accordance with the provisions of any applicable legislation.
- What choices do I have?
- 14.1. You have the right to request a copy of the personal information we hold about you or to object to the processing of personal information held about you.
- 14.2. To do this, contact us at the numbers/addresses listed earlier and specify what information you would like. We will take all reasonable steps to confirm your identity before providing details of your personal information.
- 14.3. You can always choose not to provide information. If you do want to receive e-mail or other electronic communications and mail from us, tick the opt-in box in your terms and conditions. However, please note, if you do not want to receive legal notices from us, such as this privacy policy, those notices will still govern your use of the Company services and products and it is your responsibilitytoreviewthemforchanges.
- 14.4. You have the right to ask us to update, correct or delete your personal information. You may do this by contacting us at the numbers/addresses provided earlier.
- 14.5. We will take all reasonable steps to confirm your identity before making changes to personal information we may hold about you.
- 14.6. It is your responsibility to keep your personal information accurate and up to date and advise us as soon as reasonably possible if any information is changed or outdated.
- 14.7. Please update your information by contacting us at the numbers/addresses provided earlier.
- 14.8. Please note that we may amend this Policy from time to time.
- Disposal, Deletion or Destruction of Information
15.1. All information stored by the Company is in accordance with the relevant legislation and will be kept for the following period:
15.1.1. Financial Information will be retained for 7 years in accordance with FICA, and SARS requirements; and
15.1.2. Document and personal transaction information will be retained for 5
years after the file is closed and archived.
15.2.
Once the relevant period of retention has expired, the information will be disposed in accordance with the legal requirements in which:
- 15.2.1. Digital data will be deleted from all workstation terminals and server hard drives. The Information officer will provide a signed certificate to confirm that the specific information has been deleted from all workstations and/or server/database; and
- 15.2.2. Hard copy documents and printed information will be packed, sealed and delivered to an entity that specializes in the disposal of hard copy information by incineration. These files are cataloged, referenced, logged and sealed by the Company before being collected by the third party which then records the logged and sealed boxes being incinerated
16. Security of Information and Integrity Breaches
- 16.1. The information collected by The Company is secured as described above, while the Company is committed to maintain security to the best of its ability, in the event of any breach of information integrity the following procedure and steps will be implemented:
- 16.2. We undertake to immediately, or as soon a reasonably possible, after becoming aware of the breach, inform:
- 16.2.1. The Information Regulator;
- 16.2.2. The data subject directly by telephone or email of any possible information that might be leaked in order for the data subject to mitigate and prevent any loss or potential loss arising from such information;
- 16.2.3. If the data subject cannot readily be identified, notice of the breach will be published on all media platforms (website, social media platform pages, newsletter, etc) in order for the data subjects that are clients to be aware of such breach and take the necessary precautions to mitigate any potential loss;
- 16.2.4. If the information breach is required not to be disclosed to the data subject in accordance with section 22(3) of the Act, only the
Information Regulator will be notified;
16.2.5. A report will be compiled by the Information Officer after an analysis of the breach to be submitted to the Information Regulator, detailing the breach, the possible cause/s, the probable impact on data subjects, methods of mitigating any potential loss and possible remedies to prevent similar breaches in future.
17. Notices and Revisions
17.1. If you have any concern about privacy at the Company, please e-mail us a thorough description and we will try to resolve the issue for you. We may e-mail periodic reminders of our notices and conditions, unless you have instructed us not to, but you should check our website frequently to see recent changes. Unless stated otherwise, our current privacy policy applies to all information that we have about you and your account. However, we stand behind the promises we make and will never materially change our policies and practices to make them less protective of member information collected in the past without the consent of affected members.
